By accessing or using this website, you agree to the following terms. Please read them carefully before submitting an application or engaging with any venue through Che Pom.
Nature of Service
Che Pom is a private venue curation and introduction service. We match retreat leaders and facilitators with vetted spaces in Central Vietnam.
Che Pom is not a booking platform, ticketing agent, venue operator, or party to any agreement between a retreat leader and a venue owner. Unless expressly stated otherwise, any contract for venue use is formed directly between the applicant and the venue.
Application Process
Submitting an application does not guarantee acceptance, a venue match, or a response. We reserve the right to accept or decline applications at our discretion.
Acceptance into the service may grant access to selected venue information for the purpose of evaluating potential spaces and, where appropriate, making direct contact with venue owners.
Access to venue information does not constitute a reservation, booking confirmation, guarantee of availability, or contractual commitment by Che Pom.
Privacy and Confidentiality of Venue Information
Che Pom is a privately curated collection. Certain venue names, locations, contact details, pricing, photographs, availability information, and other details may be shared privately with approved applicants.
Information identified or reasonably understood as private is provided solely for the purpose of evaluating or arranging a potential retreat.
You may not publicly publish, reproduce, distribute, scrape, commercially exploit, or add private venue information supplied by Che Pom to a public directory or database without permission from Che Pom or the relevant venue.
You may reasonably share venue information with members of your team where necessary to evaluate or organise a retreat, provided that the information remains confidential.
Accuracy of Information
We make reasonable efforts to ensure venue information is accurate and current. However, details including capacity, facilities, availability, services and pricing are subject to change and should be confirmed directly with the venue before making commitments.
Che Pom does not guarantee that all venue information will be complete, current, or error-free.
Venue Owners and Independent Operators
Venue owners listed or introduced through Che Pom are independent operators.
Venue owners are responsible for the accuracy of the information they provide and for communicating their current availability, pricing, policies and conditions.
Che Pom does not guarantee the availability, quality, performance, or suitability of any venue for a particular retreat.
Any booking, deposit, payment, cancellation, refund, rescheduling arrangement, or other contractual obligation between a retreat leader and venue owner is subject to the terms agreed between those parties.
Intellectual Property
All original content on this site, including copy, imagery, branding, design and the selection and presentation of the Che Pom collection, is owned by Che Pom or used with permission from its licensors.
No part of this site may be reproduced, distributed, systematically extracted, or used commercially without prior written permission, except where permitted by law.
Acceptable Use
You may not misuse the Che Pom website, attempt to circumvent private-access restrictions, interfere with the security or operation of the website, or use automated systems to systematically collect private venue information.
Limitation of Liability
To the fullest extent permitted by applicable law, Che Pom is not liable for loss, damage, or expense arising from an independent venue's acts or omissions, a venue introduction, or an agreement entered into directly between an applicant and venue owner.
Where liability cannot lawfully be excluded, Che Pom's liability will be limited only to the extent permitted by applicable law.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.
Governing Law
These Terms are governed by the laws of Vietnam.
Any dispute arising from or relating to these Terms should first be addressed through good-faith negotiation. If the dispute cannot be resolved, it will be submitted to the competent courts of Da Nang, Vietnam, subject to any mandatory rights or jurisdictional requirements under applicable law.
Changes to These Terms
We may update these Terms from time to time. The current version will be published on this page with an updated “Last updated” date.
Your continued use of Che Pom after an update constitutes acceptance of the revised Terms to the extent permitted by applicable law.
